1. Acceptance of Terms

By accessing or using the AkiliLearn website (akililearn.com) and related services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services. These terms apply to all visitors, users, students, parents/guardians, and tutors.

2. Services Overview

AkiliLearn is a private tutoring platform that connects students with qualified tutors across academic subjects, exam preparation, ICT & AI skills, professional upskilling, and language & music instruction. We offer both in-person and online tutoring sessions in Kenya and internationally.

3. User Accounts & Registration

• You must provide accurate, current, and complete information when submitting forms or registering for our services
• Parents or guardians must provide consent for users under the age of 18
• You are responsible for maintaining the confidentiality of any account credentials
• You agree not to impersonate any person or entity or misrepresent your affiliation

4. Booking & Payment

• Tutoring sessions are booked through our website forms, WhatsApp, or other designated channels
• Pricing is displayed on our website and may vary by subject, level, and tutor qualifications
• Payment is due before or at the time of the session unless otherwise agreed in writing
• We accept payments via M-Pesa, bank transfer, and other methods as communicated
• All prices are quoted in Kenya Shillings (KES) unless stated otherwise

5. Cancellation & Refund Policy

• Cancellations made more than 24 hours before a scheduled session will receive a full refund or credit
• Cancellations made less than 24 hours before a session may incur a cancellation fee of up to 50% of the session cost
• No-shows without prior notice will be charged the full session fee
• AkiliLearn reserves the right to cancel or reschedule sessions due to tutor unavailability, with full refund or rescheduling offered

6. Tutor Conduct & Quality

• All tutors are vetted and selected based on their qualifications, experience, and teaching ability
• AkiliLearn does not guarantee specific academic results or exam scores
• If you are unsatisfied with a tutor, contact us and we will assign a replacement at no extra cost
• Tutors are independent contractors and not employees of AkiliLearn

7. Intellectual Property

All content on the AkiliLearn website — including text, graphics, logos, images, and software — is the property of AkiliLearn or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

8. User Conduct

You agree not to:

• Use our services for any unlawful purpose
• Harass, abuse, or harm any tutor, student, or staff member
• Attempt to bypass our platform to engage tutors directly for the purpose of avoiding fees
• Submit false or misleading information in any form or survey
• Interfere with the operation of our website or services

9. Lead Generation & Marketing Communications

• By submitting a form on our website, you consent to being contacted by AkiliLearn via email, phone, SMS, or WhatsApp
• You may opt out of marketing communications at any time
• We use Google Ads, Meta/Facebook, and GoHighLevel for lead management
• Your data is processed in accordance with our Privacy Policy

10. Third-Party Services & Links

Our website may contain links or integrations with third-party services (e.g., Google Forms, GoHighLevel, WhatsApp). We are not responsible for their practices.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.

12. Limitation of Liability

AkiliLearn shall not be liable for indirect or consequential damages arising from your use of our services.

13. Indemnification

You agree to indemnify and hold harmless AkiliLearn from claims arising from your use of our services.

14. Governing Law

These Terms are governed by the laws of the Republic of Kenya.

15. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.
